1. Acceptance of these terms

avemarianaplesflorida.com (the “Website”) is operated for the real estate services of Magaly Moreno, REALTOR®, a licensed Florida real estate sales associate with Premiere Plus Realty (“we,” “us” or “our”). By using the Website you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use the Website.

2. Independent website and affiliation disclaimer

This is an independent real estate information website. It is not the official website of, and is not owned, operated, sponsored, endorsed or approved by, Ave Maria Development, Barron Collier Companies, Pulte Homes, Del Webb, Lennar, CC Homes, Ave Maria University, Panther Run Golf Club, The National Golf & Country Club, the Ave Maria Master Association, the Ave Maria Stewardship Community District, any homeowners association, any condominium association, any property owners association, any club or any government agency. References to those entities are for identification and information only. Community, builder, club and business names, trademarks and logos belong to their respective owners. No affiliation is implied unless expressly stated.

3. Information only, not an offer

The Website provides general information about Ave Maria, Florida for prospective buyers. Nothing on the Website is an offer to sell or a solicitation to buy any specific property, a promise of availability, a guarantee of price or a substitute for the disclosures, contracts and documents that govern any particular home, neighborhood, association, district or club. Any purchase is governed solely by the written contract and governing documents for that property.

4. Real estate information disclaimers

Information on the Website was researched from builder, community, county, district and other public sources believed to be reliable, and is presented with the dates on which it was researched where practical. It is not guaranteed and can change without notice. In particular:

• Property availability and listings. The Website does not publish a live MLS feed. Homes, quick move in inventory and listings referenced or requested through the Website may be sold, under contract, withdrawn or changed at any time.
• New construction and builders. Builders, neighborhoods, product lines, floor plans, releases and sales programs can be added, changed, paused or discontinued by the builder at any time.
• Prices and incentives. All prices are researched starting prices, base prices or positioning as of the stated research date. They exclude homesite premiums, options, upgrades, closing costs and other charges unless stated, and builder incentives change frequently and are subject to the builder's terms.
• HOA, master association, condominium, POA and club fees. Assessments and fees vary by property, product, parcel, phase, building and membership structure, and change with association and club budgets. Figures on the Website are examples that must be verified for the specific property.
• Stewardship Community District assessments. Ave Maria Stewardship Community District assessments, often searched as CDD fees, vary by parcel and phase, can include debt service and operations and maintenance components, and are generally collected on the property tax bill. No universal amount exists.
• Floor plans and square footage. Plan names, dimensions, bedroom and bathroom counts and square footage are approximate, are provided by builders and can differ by elevation, options and actual construction.
• Maps and travel times. Maps on the Website are schematic and not to scale. Distances and drive times are approximate estimates that vary with route, traffic, season and starting point.
• Schools. School attendance zones are set by Collier County Public Schools and can change. School information must be verified directly with the district and the schools.
• Amenities. Amenities may be existing, under construction or planned. Availability, hours, access rules and fees are set by the applicable association, district or club and can change. Completion of planned amenities is not guaranteed.
• Future development. The June 2026 master plan expansion describes long term entitlement, not homes or facilities that exist today. Future builders, neighborhoods, commercial areas, road improvements and timing can change or may never be built.
• Community rules. Pet, leasing, occupancy, age restriction, parking, architectural and other rules are set by each association, district or club in its governing documents and can change. The Website does not publish universal rules.
• Taxes. Property taxes depend on assessed value, purchase price, homestead status, exemptions, Save Our Homes limitations and non ad valorem assessments, and must be verified with the Collier County Property Appraiser, the Collier County Tax Collector and your own tax professional.
• Images. Images on the Website are conceptual illustrations of lifestyle and character. They do not depict specific completed homes, amenities or improvements unless expressly stated.

You are responsible for independently verifying any information that matters to your decision with the applicable builder, association, district, club, school system, county agency, lender, inspector, attorney or tax professional before you rely on it.

5. No professional advice

Content on the Website is general information and is not legal, tax, insurance, financial, engineering or investment advice. Consult qualified professionals for advice about your specific situation.

6. Builder registration and representation

Builder onsite sales representatives represent the builder. Builder registration and broker compensation policies vary by builder and can change. Nothing on the Website guarantees that a builder will recognize a REALTOR®, pay compensation or offer any incentive. Contact Magaly before registering with or visiting a builder if you would like independent representation.

7. Using the request form

The request form is provided for genuine real estate inquiries. You agree to provide accurate information and not to submit spam, automated or abusive submissions. Submissions are validated on our server and protected by Google reCAPTCHA; submissions that fail validation are not delivered. See the Privacy Policy for how your information is handled.

8. Intellectual property

The text, design, graphics and original artwork on the Website are owned by or licensed to us and are protected by copyright. You may view and print pages for your personal, non commercial use in evaluating real estate. You may not copy, reproduce, republish, scrape or distribute Website content for any other purpose without written permission. Third party names, marks and materials remain the property of their owners.

9. Third party websites and services

The Website links to third party websites and uses third party services, including Google (tag, reCAPTCHA, Fonts and an optional Maps embed), Meta (Pixel) and Zoho (CRM). We do not control and are not responsible for third party content, availability, accuracy or privacy practices. Links are provided for convenience and do not imply endorsement.

10. Disclaimer of warranties

The Website is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non infringement. We do not warrant that the Website will be uninterrupted, error free or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Magaly Moreno, Premiere Plus Realty and their affiliates, agents and contractors are not liable for any direct, indirect, incidental, consequential or special damages arising from your use of, or reliance on, the Website or its content, including decisions made about any property, price, fee, assessment, school, travel time, amenity or future development. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

Information and services are provided without regard to race, color, religion, sex, disability, familial status, national origin or any other protected class. Age restricted communities described on the Website operate under applicable federal and state housing for older persons rules and their own governing documents.

13. Governing law

These terms are governed by the laws of the State of Florida without regard to conflict of law principles. Any dispute arising from the Website will be resolved in the state or federal courts located in Collier County, Florida, and you consent to that jurisdiction.

14. Changes to these terms

We may update these Terms and Conditions at any time. The effective date at the top of the page shows the latest revision. Continued use of the Website after a change means you accept the updated terms.
